12. Can a Foreign Company Owner Obtain a Work Permit in Türkiye?

            Yes.             For a foreign shareholder who is also a manager of a limited liability company, the Ministry of Labour and Social Security applies specific financial and employment criteria when evaluating the work permit application.

 

General Criteria for a Foreign Company Shareholder

            For a newly established business or a foreigner becoming a shareholder, the general criteria include:

  • The company's paid-in capital must be at least TRY 500,000;
  • The foreign shareholder must hold a capital share of at least TRY 500,000, representing at least 20% of the company's capital; and
  • The company must employ at least five Turkish citizens.

 

            The requirement to employ at least five Turkish citizens is subject to a specific transition period for the first work permit. The initial work permit issued to the foreign company shareholder is subject to a condition, and the employment of at least five Turkish citizens is generally required from the beginning of the seventh month of the initial work permit period.

 

 

Special Rule for Foreign Shareholders with USD 100,000 or More in Capital

            A significant exception applies to foreign shareholders whose capital share is at least USD 100,000.

 

            In this case, the financial and employment criteria described above do not apply. Accordingly, the foreign shareholder is not required to meet the TRY 500,000 capital-share threshold or the five-Turkish-employee requirement under these specific criteria.

 

 

Residence Permit and Application Procedure

            Whether the application should be submitted from within Türkiye or from abroad depends on the foreigner's immigration status and circumstances.

 

            As a general rule, a foreigner applying from within Türkiye must have a residence permit that was issued for at least six months and remains valid on the date of application. Certain categories of foreigners may qualify for an in-country application without a valid residence permit, subject to the applicable rules.

 

            Work permit applications are submitted through the Ministry of Labour and Social Security's electronic system. Where the application and supporting documentation are complete, the Ministry generally concludes the assessment within 30 days.
